    The point system has worked well in both Canada and New Zealand and have moved those who meet the threshold through the immigration system faster. As an non paying IV member, I am not in favor of opposing the current bill.

    Please voice your concerns to IV Administrators or if you have any misunderstanding or less understanding about what's going on.

    We all agree that Point system is more universal - But for guys who are waiting since 2001 ( say LC from CA/NY/NJ etc..) do you think its a justice
    to go through Points system again from Scratch ??

    Getting more VISA numbers to flush out the Half Million Backlog is 1st Priority according to Majority in this Forum ....

    All 140K GCs are available on Oct 1. However, dates were not current in 2005 and 2006. I think that current dates do not depend on available GCs.

    Looks like current dates depend on # submitted AOS's. USCIS is saying that on Jul 2 it has submitted AOS's that exhaust submitted AOS quota.
    the availability of dates are determined by DOS after consulting with labor department and USCIS. if the they determine that enough labor applications are pending to fill the entire quota for the year they issue the cut off dates accordingly.
    India is allocated only 10,000 visas in all categories(EB1+EB2+EB3). dates will never be current, given around 700K applicants were ready to file. out of the 700K I imagine atleast 35% will be from india, which translate to around 250K applicants from india who are ready to file I-485, india is given 10K , u can do the math and find out for yourself how much time it will take for the dates to be current.

    Even if USCIS reverts the decision back to use Vertical spill overs, it won't change the EB3-I PD position a dime. As it didn't change with that way in the past. So, there is no use in asking USCIS to change it back to Vertical from Horizontal spill over.

    As somebody mentioned earlier, they were all taken by EB3 other workers all these years, it is better to ask USCIS to give preference to EB3-I and EB3-C before giving it to EB3 Other works so that they can get better share to complement for the lost happened all these years. I can understand the EB3-I frustration. We need to analyze who got the major share all these years and ask USCIS to give them to others lost in retrogression (EB3-I, EB3-C, EB2-I, EB2-C).

    Otherwise, only way to get a common ground is, recapture and dependent exception bills. We should all work for these two common bills.

    It may not directly harm visa recapture or any other official IV campaigns - at least for now! But don't you think if EB3-I campaign to revert to the old way of handling the overflow succeeds at all their will be an immediate follow up, counter campaign to re-revert the decision by EB2s? I don't see an end to this fight and I don't see any winners in the long term.

    Again, I'm not saying you shouldn't run your campaign. You have every right to do so. But please accept this for what it is. It will cause a split in IV members and that can not be avoided.

    that Senior Members would be more involved in posting on this website. It makes a lot of difference if core members who have a closer perspective of the truth could respond to some questions on these threads. No response, in my opinion only helps in making the website dead and promotes unproductive arguments and squabbles here.


    It is "good" that they are not talking. That means they are working harder and something good is expected to happen.

    If there is more talk then outcome is less. This is my experience from past one plus year from IV and other immigration forums. When everyone get "too much" excited and keep posting madly about some "immature deal", at the end of the day nothing "concrete" is achived.

    Let IV do their work. I am hopeful something "good" will happen in near future.

    Why don;t you sign unless it say until and after 1 year approval:, you can leave employment after 6 months of filing I-485 and see what happens at that time, you have nothing to loose

    I have dealt all options with my employer ...

    They will give me "Employer Letter" ASAP but i have to sign a letter that i'll work with them for 1 year after getting 485 approval.

    What does it mean - Indirectly i have to work with them till 485 approval ( which could be 3 yrs easily) plus another 1 year ??

    It would be more effective if not effecient. You need not wait until the year end to issue visas, visas can be issued using a mathematical model which would allow old PD filers to get a visa ahead of others as soon as his case comes in and other criterias are fullfilled. Basically no one needs to wait for filing I485. People with old PD will get visa numbers first as soon as they enter the application.

    You're kidding me...How is your suggestion more efficient..????
    So they should keep sorting and moving visa numbers from one application to another based on PD.??
    if thats the case they would have to wait to give GC on the very last day of the year...

    What I did till now.
    1) Contacted Senator/Congressman/Governor
    2) Filled 7001 form for Ombudsman
    3) Called USCIS 10 times in last 10 days and come to know that everything is cleared on my and wife applications.
    4) Strange thing applied EAD on July 15th 2008 and got approved today august 12 2008.

    Did you do all this for EAD?

    OK. So now we are fighting between EB2-India and EB3-India, are we?
    Before it was ROW and India.
    The Anti-Immgration folks spying on this forum must be havinga good laugh!

    I am sorry if it felt like fight Lasantha.

    The point I am trying to make is that things will not improve if we point at each other...IV is a place to come together and fight.

    If you read all my posts you would realize that I pointed this issue out in May (trying to predict what would happen to EB3 based on their interpretation). An something needs to be done for EB3 as many people are stuck with their families for several years. All I am trying to urge everyone is to come together and think of a concrete plan rather than doing the "word battle".

    Once such plan would be to think what type of EB immigration policy change would we advocate in proposed CIR. (again I am sure discussion about this will heat up when "horses are out of barn"; but I think this is the right time to do it) CIR will surely come again on the floor after elections. We need OUR strategy for it...do we have one??
    A strategy that would benefit everyone : may it be EB1, EB2 or EB3.

    This is all about looking forward...

    And with all honesty, any amount of campaigning from IV or any other organization is not likely to change August bulletin and what USCIS and DOS has planned to do in next couple of months. I have information to support this statement and I will post it soon.

    What we can do is to change the law for good with CIR. For that we will need strength, if EB3s leave IV, we will loose our own strength.

    I dont know how else to make my point...

    It is a fact that EB3 India is a FORGOTTEN category. There appears to be a sense of intra-category elitism within the larger community that comes together at IV. EB3 I's make feeble attempts to be heard and some take a shot at innovative marketing campaigns to call attention to the plight of being stuck for over 6 ot 7 years in some cases. EB2 I's immediately respond with a self protectionist attitude and preach a higher calling that focuses on comprehensive solutions instead of piecemeal solutions. EB1 I's obviously choose to remain outside the fray, since these are matter of concern to vox populi, not them.

    Some EB2's and EB3's then analyse the hell out of USCIS logic, to the extent that they could become full time spin meisters for ANY public organization. With very little fact, a healthy dose of opinion and a mish mash of 'logic', they piece together their 'strong' arguments -one way or the other.

    Lost in this useless din of irrelevant analysis paralysis is the real misery of thousands of EB3 I's (such as myself) that have been stuck for years for no fault of ours. By the way, I happen to be a highly educated (for those that care) Executive that went to Top Private Universities in the US that happens to be stuck in EB3 ONLY because the company HR rep and lawyer at the time, chose to go down this path. POint being, there is no reason for EB2 I's to pontificate from a sense of elitist protectionism because there are EB3 I's like me that can outsmart a bunch of you in no time. Seriously. (This is for those that preach that if you are 'smart' you should be in EB2. Go read those threads).

    So bottomline, let us stop behaving like CIS vs Anti CIS camps and instead UNITE towards the common cause. Let EB3I's air their frustrations. If you can come to help, do so. If not, stay out of it completely. No more half ass 'logic', please.

    As per web page on this link -Do allow all employees (including non-U.S. citizens) to provide any permissible documents to establish their identity or work authorization during the employment verification process.This will exclude applicants on H-1B visa status as they don't have work authorization to work for the new employer.

    However, as I said before, Employer can not discriminate between GC holder, EAD, and OPT holder.
