My attorney received the receipt notice for I-485 application today.

I am curious to know what's stopping the EB3s to port their dates to the EB2 category. I've been seriously considering this lately.
I tried doing that. Convinced the employer to file a new labor for a new position, advertized again, filed a new labor under PERM, applied for a new I-140 and waited for a year for approval ... now the I-140 has been denied for A2P and is under appeal; I must confess that I have lost hope that it'll get re-opened and approved.
So all my efforts for getting a EB2 140 have failed.....what do you recommend, I start this entire process again. Even if I'm willing to bear the cost, the employer will not file yet another labor.
EB3 wait is my only way out now......

you've taken one sliver of info out of that case and making it seem like thats a primary issue... i dont doubt that what you are purporting is true... but your link pointed to something that was a complete waste of time... i agree that you need to have a permanent full time job and that permanent means indefinite in most cases related to immigration.

I think it depends on who the primary applicant is in your Canadian PR application. If you are the primary applicant (and used your spouce's qualifications to get the extra points), you should be able to do the landing alone. But if you are the secondary applicant and your wife is the primary then I don't think you can land without her.

I have a electronic mail from them with the 140 receipt Notice (as PDF)
from USCIS.. I took the LIN number from there and Queries USCIS - they says USCIS received my App on May 15th and under processing....
I took a Print out of that 140 receipt Notice and will attach with 485 Application... My approval will not come before Jan-Feb 2008.
Just wanted to let you know, if your 140 is pending, you will have to submit the receipt notice and also the copy of labor cert showing the PD. Read page 4 below the NSC mailing address.

Got receipt notice for I-485/AP/EAD/ from USCIS today (8/30/2007). My package was delivered to Nebraska center on July/27/2007. Notice date is August 21st, 2007. My priority date is Dec/23rd/2003.

I am starting this new thread to discuss about EB visas spillover usage based on oldest priority date irrespective of category/country. Currently the spillover happens vertically(a top down approach) from EB1 -> EB2 -> EB3...etc. Instead it should be first used on cases with oldest priority date. This will not only give a good move to clear the backlog but will also be a fair rule for those who are patiently waiting in queue for a long time. I wrote my concern about this to my local congressman. I also request each one of you, who is impacted by this, or who is interested to help us out, to kindly contact your local congressman/woman to express your concern. In turn they can contact USCIS to implement this fair rule to help us all out.

Hi,
Yesterday I got the response for my SR opened on 10/16 for still not receiving FP notice yet. The letter says that the processing on my case has been delayed since the background check on my application is still open. Please contact after 6 months if you still haven't heard back from us. My assumptions are:
1. Since they did not mention any where in the letter about biometrics, they are talking about my 485 petition and not my finger printing notice. Guess they misunderstood why I opened the SR with them. Does that make sense?
2.Is it possible that I haven't received FP notice since my background check is still in progress? I thought that these were two independent process...
Any suggestions would be appreciated!

My frined got receipt from TSC yesterday, his attorney sent package them on 31st , I think they got it on June 1st. He has not got finger printing notice yet.
I applied on May 18th 140/485 Nebraska, Got receipt on May 28 from TSC with finger printing schedule after 2 weeks. 140 got approved on 23rd May.
Friends, My friends is saying if the New bill approves then we might have to re-apply again, even wealready have applied 485, is this True? I am bit confuse, I aksed to my Lawyer he said your Labor and 140 is New , he cannot tell anything at this point. If the person is already applied and waiting for Card should be effected, any opinion?

the january 2008 visa bulletin reflects that the eb3 category has a priority date of october 15,2002. are we made to believe that those persons who have priority dates of october 15,2002 and earlier, did not immediately file for adjustment of status but instead they will only file now this coming january 2008? is it believable that there are still applicants who will be filing now this janiuary 2008 even though their priority date is as early as october 15,2002?

They are not personal checks. So there is no way for me to find if the checks were cashed or not. But attorney said, it takes minimum two weeks. But it looks like many have gotten their receipts.
